EPA Published Strategy for Developing/Revising Effluent Guidelines
EPA has published its Strategy for Developing/Revising effluent guidelines and is seeking comments. Although comment period is scheduled to end February 17, 2004, an extension of 30 days is expected.

EPA Issues Proposed Interstate Air Quality Rule Affecting 29 States and Announces Upcoming Public Hearings
On January 30, 2004 EPA proposed an Interstate Air Quality Rule which is intended to reduce interstate transport of fine particulate matter and Ozone (Federal Register, 69 Federal Register 4565-4614 (January 30, 2004). The proposal finds that 29 States and the District of Columbia contribute significantly to non-attainment of the National Ambient Air Quality Standards (NAAQS) for fine particles (PM 2.5) and/or 8-hour ozone in downwind States. EPA is proposing to require upwind States to revise their State Implementation Plans (SIPs) to include control measures to reduce emissions of sulfur dioxide (SO2) and/or nitrogen oxides (NOx). On February 2, 2004, EPA published the dates and locations (although detailed information for the meetings (sites, times, etc) will be posted in EPA’s websites as they become available) for the public hearings for this proposed rule and other associated rulemaking proposals: February 25 and 26, 2004 in Chicago, IL; Philadelphia, PA; and the Research Triangle Park, NC (all simultaneous meetings)

Evening Flights A Noisy Nightmare
The noisy nighttime skies above Cincinnati/Northern Kentucky International, already a source of consternation among some residents, could force the airport to purchase more houses. But airport officials stress that would only occur if they were unable to tone down noise levels with a new set of nighttime takeoff and landing procedures, which the airport is currently testing.

EPA EXTENDS SPCC DEADLINES BY 18 MONTHS
This week EPA made available a pre-publication Federal Register Notice signed by the administrator extending the SPCC deadlines for the new rule by 18 months. EPA also announced that only those provisions of the rule that are less stringent or burden reducing would still be in effect and that the implementation of any requirements that are new or more stringent than the old rule would be extended by 18 months. EPA ISSUES FINAL RULE EXTENDING SPCC DEADLINES BY 60 DAYS AND PROPOSES RULE EXTENDING DEADLINES FOR ONE YEAR
Today EPA published in the Federal Register an Interim Final Rule that extends, effective today, January 9, 2003, for sixty days, the dates for a facility to amend and implement its Spill Prevention, Control, and Countermeasure (SPCC) Plan. EPA is issuing this extension in order to avoid a flood of individual extension requests and to allow for adequate consideration of comments EPA expects to receive on a proposed one-year extension of the dates published also included in today’s Federal Register. Bush Administration Publishes the National Wetlands Mitigation Action Plan
The Army Corps of Engineers, in consultation with the Environmental Protection Agency, the Department of Agriculture, the Department of the Interior, the Federal Highway Administration and the National Oceanic Atmospheric Administration, has re-evaluated its mitigation Regulatory Guidance Letter and is reissuing it to improve mitigation implementation provisions. Since wetlands are an issue in airport expansions, this Guidance is of interest to airports.

EPA published a Draft Strategy for National Clean Water Industrial Regulations
On November 29, 2002 EPA published a Draft Strategy for National Clean Water Industrial Regulations. Under the Clean Water Act, EPA is required to established national technology-based regulations, termed “effluent guidelines”, to reduce pollutant discharges from industrial facilities to surface waters and publicly owned treatment works. The draft strategy describes a process to identify existing effluent guidelines that EPA should consider revising, and to identify any industrial categories for which the Agency should consider developing new effluent guidelines. EPA proposes to use this process to develop future Effluent Guidelines Program Plans, which EPA is required to publish under section 304(m) of the Clean Water Act every two years. Philly Runways Named For Accelerated EIS (Updated)
Philadelphia International’s runway construction plans will receive streamlined environmental review under terms of a new executive order, DOT announced on Thursday. New Environmental Affairs Director Joins AAAE
Claudio H. Ternieden has joined the Regulatory Affairs Department of AAAE as the new Director of Environmental Affairs. Claudio comes from the Indiana Department of Environmental Management (IDEM) where he assisted in developing and implementing Indiana’s Great Lakes Water Quality Standards and in overseeing Indiana’s drinking water construction permits and capacity development programs. While at IDEM, Claudio worked with EPA Headquarters in Washington, DC under an intergovernmental assignment. He advised on implementation issues associated with industrial sectors in the Office of Policy, Economics and Innovation and in developing federal water regulations for cooling water intake structures at new and existing large power plants in the Office of Water. He has a law degree and a certificate in Environmental Law from Pace University School of Law, in White Plains, NY, and started his career as a Pretreatment Director for the City of Elkhart, Indiana before joining IDEM.
